DRAFT — not legal advice, not reviewed by a lawyer, requires sign-off before use.
This document was drafted by an AI compliance agent on 28 September 2026. It has not been reviewed by a licensed Australian legal practitioner and has not been approved by the product owner. It is not published, not binding, and must not be shown to real users in this state. Every square-bracketed placeholder must be filled and the whole document reviewed and signed off — ideally by an Australian lawyer, not only by the product owner — before it goes anywhere near production.

The line that matters
This is an estimate for record-keeping, not tax advice. For tax advice, see a registered tax agent.
That sentence appears beside every tax figure in Auspensify and it is not dismissible. This page explains what sits behind it.
1. Auspensify is a record-keeping and calculation tool
Auspensify helps you keep your income, expense and receipt records organised across the financial year, and it does arithmetic on the figures you enter using published Australian Taxation Office (ATO) rate tables.
That is the whole of what it does. Auspensify:
- is not a registered tax agent and is not a registered BAS agent;
- is not a registered tax agent service, and does not provide tax agent services;
- does not give you tax advice, financial advice, financial product advice, accounting advice, superannuation advice or legal advice;
- does not prepare, review, sign or lodge your tax return, your business activity statement or any other approved form;
- does not deal with the ATO on your behalf, and cannot represent you in any dealing with the ATO;
- does not tell you what you may or may not claim, what your obligations are, or how any tax law applies to your particular circumstances.
Under the Tax Agent Services Act 2009 (Cth), a person must be registered with the Tax Practitioners Board (TPB) to provide a tax agent service for a fee or other reward (s 50-5). Auspensify is a general-purpose, non-customised record-keeping and calculation tool: you enter your own figures, and the software applies published rates to them. The TPB has published guidance to the effect that a digital service provider supplying non-customised software is not, by that supply alone, providing a tax agent service — even where the software includes tax calculators — because it is supplying a tool that helps you meet your own obligations rather than applying tax law to your circumstances on your behalf. Auspensify is built and operated to stay firmly on that side of the line.
What that means for you in practice: nothing Auspensify shows you is a professional opinion, and nothing in it is a substitute for one. If you need to know what to do, speak to a registered tax agent. You can check whether someone is registered on the TPB Register at tpb.gov.au/public-register.
2. What "estimate" actually means here
Every tax figure in Auspensify — your consolidated Tax position, every per-bucket estimate, and every "roughly yours to keep" figure — is a mathematical estimate. It is produced by applying published ATO rates to the figures you have recorded and the profile facts you have entered. It is arithmetic, not an assessment and not a prediction.
Estimates are calculated on Auspensify's servers against a dated, versioned rate table, so that any figure you see can be traced back to the rates it was produced from. Auspensify never computes a tax figure in your browser.
Your estimate will very likely differ from your actual ATO assessment
Not "may" — will likely. Some of the reasons:
- It only knows what you have entered. Income you have not recorded, deductions you have not captured, and receipts you have not attached simply are not in the calculation.
- It relies on the accuracy of your entries. Auspensify does not verify your figures against your bank, your payslips, your payment summaries or the ATO. A typo in an amount or a date flows straight through to the estimate.
- It does not model everything the ATO does. Auspensify's estimate is deliberately narrow. Among the things it does not attempt to work out for you: the deductibility of any particular expense; capital gains tax calculations, discounts, exemptions or cost-base adjustments; depreciation and capital works schedules; foreign income, foreign tax offsets or double-tax agreements; trust and partnership distributions; superannuation contributions, caps or Division 293 tax; PAYG instalments; employee share schemes; small-business concessions; offsets and rebates beyond the ones stated in the app; and amendments to prior-year returns.
- Rates and thresholds change. Tax rates, levy thresholds, offsets, the Medicare levy surcharge and HELP/HECS repayment settings are set by legislation and change, sometimes retrospectively and sometimes part-way through a year. An estimate produced under one rate table will not match an assessment made under another.
- Timing. An estimate produced mid-year is based on a partial year of records. It is not a forecast of your year-end position.
- The ATO has information Auspensify does not — including data reported directly to it by employers, banks, health insurers, share registries and other agencies.
Only the ATO can assess your tax. An Auspensify estimate has no legal status, is not an ATO product, is not endorsed by or affiliated with the ATO, and cannot be relied on in any dealing with the ATO.
3. What each figure covers — and what it deliberately leaves out
Auspensify shows tax figures at two levels, and they are scoped differently on purpose:
| Figure | Includes | Excludes |
|---|---|---|
| Consolidated Tax position (dashboard) | Income tax, Medicare levy, HELP/HECS compulsory repayment, and any Medicare levy surcharge or low-income tax offset that applies, net of PAYG amounts you have recorded as withheld | GST |
| Per-bucket estimate (bucket detail) | Income tax and Medicare levy for that bucket only | HELP/HECS (it is worked out across your whole income, not per bucket), and GST |
GST is always tracked separately and is never mixed into an income-tax figure. The GST and BAS block on a bucket is a record of the GST you have recorded on that bucket's transactions. It is not a prepared BAS, it is not lodged anywhere, and Auspensify is not a registered BAS agent service. Whether you need to register for GST, and what belongs on your BAS, is a question for a registered tax or BAS agent.
"Roughly yours to keep" is exactly that — rough. It is the bucket's net recorded income less the estimated income tax on it. It is a planning aid for setting money aside, not a statement of what is legally yours.
4. "Recorded, not calculated"
Some figures in Auspensify are numbers you type in, which the app stores and displays but does not calculate, verify or adjust. These are labelled "recorded, not calculated" in the app and include:
- franking credits;
- net capital gain;
- rental property acquisition date and amount, and depreciation;
- spouse taxable income (where you have set your profile to family).
Auspensify does not check these against any source and does not tell you whether the figure you have entered is the right one. Working out the correct figure is your responsibility, and a registered tax agent is the right person to help you do it.
Rental buckets in this version assume a single owner with 100% ownership. If a property is co-owned, Auspensify's figures for it will not reflect your actual share, and you should not use them as though they did.
5. Your responsibilities
Using Auspensify does not move any of your tax obligations onto Auspensify. You remain responsible for:
- the accuracy and completeness of everything you enter;
- lodging your own returns and statements, on time, and for what they say;
- keeping your own records. Australian tax law generally requires you to retain records that explain your transactions for five years (see Income Tax Assessment Act 1936 (Cth) s 262A and current ATO record-keeping guidance). Auspensify's document vault is a convenience, not a substitute for your own record-keeping — and if you choose an external or local storage destination for your documents, Auspensify's retention commitment does not apply at all (see the Terms of Service and Privacy Policy);
- getting your own advice before you act on anything you see in the app.
6. No warranty as to accuracy
Auspensify takes reasonable care with its arithmetic and with keeping rate tables current, but it does not warrant that any estimate is accurate, complete, current or fit for any particular purpose, and does not warrant that any figure will match an ATO assessment.
This does not exclude your rights under the Australian Consumer Law. Nothing on this page excludes, restricts or modifies any guarantee, right or remedy you have under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law in Schedule 2) or any other law that cannot lawfully be excluded. Where Auspensify's liability cannot lawfully be excluded, it is limited only to the extent the law permits. See the Limitation of Liability section of the Terms of Service.
7. Where to get actual advice
- A registered tax agent or BAS agent. Check registration on the TPB Register: tpb.gov.au/public-register.
- The ATO, for your own assessment, account balance, lodgement obligations and rulings: ato.gov.au.
- A licensed financial adviser, for anything to do with financial products, investments or superannuation strategy.
